What happens when the Home Office suspends a sponsor licence?
Following a compliance visit, which will often be unannounced, if the Home Office has concerns about your Sponsor Licence compliance, it may send you a letter, normally by email, notifying you of the suspension of your licence until further investigations are concluded. In some cases, they may downgrade your Sponsor Licence to a B-rating, meaning that you will need to take steps to resolve the issues that have been identified.
If you receive notification that your Sponsor Licence is being suspended, you must contact us immediately. We will carefully consider the reasons the Home Office has given for the suspension and advise you on the course of action that is in your best interests. Our Business Immigration Solicitors will request a copy of the notes taken by the compliance officer during their compliance visit and assess whether you have any defence to the allegations, and if not, we will provide the Home Office with an explanation for the breaches and set out the action points you are taking to prevent them from happening again.
How will the revocation of my Sponsor Licence affect my business?
If your Sponsor Licence is revoked, not only will you not be able to recruit new talent from abroad, your current migrant workers will have their work visa curtailed (shortened), meaning they will need to return to their home country. Your business will also be barred from applying for another Sponsor Licence for at least one year.
There are certain circumstances that will result in a mandatory revocation of your licence. These include, but are not limited to:
You provided false information on your Sponsor Licence application.
Your business ceases to trade and/or operate.
You employ a migrant in a role that does not meet the requirements as set out in the Guidance for Sponsors.
Your licence has been downgraded to a B-rating and has not met any of the requirements contained in the Home Office action plan within the specified period.
