Below are some frequent questions regarding Indefinite Leave To Remain.
What is Indefinite Leave To Remain?
ILR, also known as Settlement, allows you to live in the UK without any visa restrictions. For example, you can work for an employer who does not have a UK Sponsor Licence and access public funds. You can also freely leave and enter the country and after one year of having ILR status you will be eligible to apply for British Citizenship.
When can you apply for ILR?
In most cases you will need to have lived in the UK legally, i.e. on a visa, for five years, although some visas, for example the Innovator Visa, provide for shorter ILR qualifying periods.
What if my ILR application is refused?
If your Settlement application is refused, your letter from UK Visas and Immigration should detail the reasons for the refusal. Our Immigration Solicitors will carefully examine these reasons and advise you on the next best steps. This could be submitting a new application, applying for Administrative Review, or appealing on human rights grounds. As a last resort you may have grounds to bring a Judicial Review claim. You can be confident that we will always have you and your family’s best interests at the centre of any advice we give.
Why are ILR applications refused?
UK Visas and Immigration refuse ILR applications for several reasons, including:
Incorrectly completed forms.
You have breached immigration rules in the past.
You have criminal convictions.
You have been absent from the UK for more than 180 days in any given 12 month period within your overall qualifying period.
You did not disclose a County Court Judgment concerning unpaid debt and/or kept up with the required payments.
