The special reasons argument is not a legal defence but if successful it could be used to not only avoid a driving disqualification but any penalties for that offence altogether.
What is a special reasons argument?
Special reasons is NOT a legal defence. Special reasons is used to convince the courts to not punish you for the offence that you have been charged with, despite technically being guilty of the offence.
Examples of special reasons
Drink Driving Offences
- Drink was spiked
- Reflux
- You were driving in an emergency
Drug Driving Offences
- Consuming a drug unknowingly
- Short distance travelled
- Driving in an emergency
Speeding Offences
- Driving in an emergency
- Driving somebody to the hospital
- Driving to get away from a dangerous personal situation
Driving with no insurance
- Genuine belief that you were insured
