What is Administrative Review?
If you believe the caseworker who decided on your visa application made an error you may be able to apply for Administrative Review. Not all UK Visa and Immigration decisions are eligible for Administrative Review, however, our Immigration Law Solicitors can quickly let you know if your particular application qualifies.
What is a case working error that would trigger the right to ask for an Administrative Review?
A case working error is defined in the Immigration Rules as:
Where the original decision maker’s decision…was incorrect’ or ‘where there has been an error in calculating the correct period or conditions of immigration leave either held or to be granted.’
How long do I have to apply for Administrative Review?
If you are outside the UK when making a visa application you must apply for Administrative Review within 28 days of receiving UK Visas and Immigration’s decision. If you are already in the UK and your visa application was rejected, you only have 14 days to apply.
Do I need to provide evidence of a case working error?
Absolutely, and the more evidence you provide the greater your chances of success.
